Effective date: Last updated:

These Terms and Conditions are an agreement between you and FanFundU. They cover your use of our website, supporter and team admin accounts, team tools such as the Share Hub, our shopping cashback and fundraising features, and the FanFundU browser extension. By creating an account or using FanFundU, you agree to these terms.

Agreement to These Terms

FanFundU turns everyday online shopping into fundraising for school teams, booster clubs, and youth organizations. The service is operated by [ Legal entity name and state of formation — to be confirmed before publication ] (“FanFundU,” “we,” “us”). By accessing our website, registering an account, installing our browser extension, or using any FanFundU feature, you accept these terms. If you do not agree, do not use the service.

Our Privacy Policy explains how we handle information and is part of your agreement with us.

Eligibility

You must be at least 18 years old and able to form a binding contract to create a FanFundU account. Accounts are for adults — parents, coaches, boosters, and other supporters. The service is intended for use in the United States.

You agree to provide accurate registration information and to keep your account credentials secure. You are responsible for activity that occurs under your account.

Accounts and Roles

FanFundU offers different account roles. The same person may hold more than one role.

Supporters

Supporters shop through FanFundU links or the browser extension so that qualifying purchases generate cashback for the teams they choose. A supporter account is free.

Team admins and coaches

Team admins register and manage a team or organization on FanFundU, invite supporters, and manage payout information. Admins represent that they are authorized to act for the team or organization they register, and are responsible for the accuracy of the team and payout information they provide.

Multi-team support and split allocation

Supporters may support up to five teams and may allocate their cashback among them using split percentages. A change applies to purchases reported after the change; cashback already credited to a team stays with that team.

Team Registration and Admin Responsibilities

When you register a team, you agree to provide accurate team, organization, and contact information and to keep it current. Team admins are responsible for the accuracy of payout details and for ensuring funds are used consistently with the rules of their team or organization.

FanFundU may ask for reasonable verification of a team, organization, or admin before enabling features or releasing payouts, and may decline or remove teams that cannot be verified.

Share Hub, Invites, and Roster Imports

The Share Hub lets team admins and supporters share invite links, and lets team admins add contacts (including by pasting or uploading a list) and players to a team roster. You may only add contacts you have permission to invite, and they may be used only for team invitations and team-related communications — not for unrelated marketing.

Invitations are sent from your own email, text, or messaging app; FanFundU does not send them or add imported contacts to its own lists. You are responsible for complying with applicable communication laws and for honoring a recipient’s request not to be contacted.

Players, who are often minors, can be added to a team roster by a coach or add themselves with the team’s roster link; they do not need an account. Coaches must add players only with a parent’s or guardian’s permission.

Shopping, Cashback, and Fundraising Rules

Cashback fundraising depends on partner stores and affiliate networks reporting qualifying orders to FanFundU. Stores pay FanFundU a commission on qualifying purchases, and a share of it is credited to your team as cashback. The rules below describe how attribution works.

Purchases occur on retailer sites

All purchases are made directly with the retailer. FanFundU does not process your checkout, take payment for retail orders, or become a party to your purchase. The retailer’s own terms, prices, and policies apply to every order.

Tracked links and extension activation

A purchase can earn cashback only when it is tracked — by going to a partner store through a FanFundU link, or by activating the browser extension, while signed in and before checkout. Purchases that were not tracked cannot be credited later. If a tracked order does not appear, you can report it and we will ask the store, but crediting is the store’s or network’s decision.

Pending vs confirmed rewards

Reported orders first appear as pending. A reward becomes confirmed only after the merchant or network confirms the order as qualifying, typically after the return window closes. Pending amounts are estimates and may change or be removed based on merchant reporting.

Returns, cancellations, and reversals

If an order is returned, cancelled, adjusted, or reported as non-qualifying, the related reward may be reduced or reversed, even after it appeared as pending or confirmed.

Exclusions and non-qualifying purchases

Merchants may exclude certain items, categories, gift card purchases, or orders combined with other coupons or programs. Cashback rates and participating stores change over time. FanFundU does not guarantee any particular earnings amount for a supporter or a team.

Browser Extension Terms

The FanFundU browser extension notifies you when a store you are visiting participates in the program and lets you activate cashback for your team. When you use the extension, cashback is earned only if you activate it at a partner store before checkout; visiting a store without activating does not earn rewards. If another affiliate, coupon site, or ad referred you to the store, the extension steps aside and that purchase may not earn cashback. The extension works on partner stores as described in our Privacy Policy.

You may pause, disable, or uninstall the extension at any time from your browser settings. Uninstalling the extension does not close your FanFundU account.

Team Payouts

Confirmed rewards accumulate in a team’s balance and are paid monthly through Stripe to the account the team admin connects; until that setup is complete, confirmed rewards keep accruing. Balances under the minimum shown in the product roll over to the next month, and large payouts may wait for manual review. Timing depends on when merchants confirm rewards and on Stripe’s processing times.

FanFundU may withhold or delay a payout while it verifies team information, investigates suspected abuse, or corrects reporting errors. Amounts reversed by merchants before a payout are not paid out.

Direct Donations

Donations are voluntary card payments to the team you select, processed by Stripe. The team receives the full donation amount; you pay the card processing fee shown before you confirm. You may add an optional tip, which goes to FanFundU, not the team. Unless expressly stated otherwise, FanFundU is not a charity and donations are not represented as tax-deductible.

Acceptable Use and Prohibited Conduct

You agree to use FanFundU honestly and lawfully. The following are prohibited:

  • Fake or duplicate accounts. Creating accounts with false identities, or multiple accounts to manipulate rewards or referrals.
  • Attribution manipulation. Self-referral schemes, cookie stuffing, forced clicks, automated traffic, or any attempt to earn cashback on purchases that were not genuinely made through the program.
  • Misrepresenting a team. Registering a team you are not authorized to represent, or providing false payout information.
  • Misusing contact data. Importing or messaging contacts without permission, or using roster data for purposes other than team invitations and communications.
  • Interfering with the service. Probing, scraping, reverse engineering, or disrupting the operation or security of FanFundU.

User Content

You may submit content such as team names, descriptions, logos, and messages. You retain ownership of your content and grant FanFundU a non-exclusive license to host, display, and share it as needed to run the service — for example, showing a team page to its supporters.

You are responsible for having the rights to the content you submit. We may remove content that violates these terms or the rights of others.

Intellectual Property

FanFundU, our logo, and the design of our website, product, and extension belong to FanFundU or our licensors. Retailer names and logos belong to their respective owners; their appearance on FanFundU indicates participation in the program and not sponsorship or endorsement of FanFundU or any team.

We grant you a limited, personal, non-transferable license to use the service as intended by these terms.

Third-Party Stores, Links, and Services

FanFundU links to partner stores and works with affiliate networks and payment providers. These third parties operate under their own terms and privacy policies. FanFundU is not responsible for the products, prices, availability, or conduct of partner stores, or for issues with orders you place on their sites.

Disclaimers

FanFundU is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free, that every purchase will track, or that any level of fundraising will be achieved.

Limitation of Liability

To the fullest extent permitted by law, FanFundU will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost fundraising opportunities, arising from your use of the service.

Our total liability for claims relating to the service will not exceed the greater of one hundred U.S. dollars ($100) or the amounts paid out to your team through FanFundU in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless FanFundU and its officers, employees, and partners from claims and expenses (including reasonable attorneys’ fees) arising from your breach of these terms, your misuse of the service, or your violation of law or the rights of others — including claims arising from contacts you import or communications you send.

Suspension and Termination

You may ask us to close your account at any time by contacting us at support@fanfundu.com or through our contact form. We may suspend or terminate accounts or teams that violate these terms, that we cannot verify, or that create risk for FanFundU or other users. On termination for abuse, unconfirmed or fraudulently obtained rewards may be forfeited.

Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — survive.

Changes to These Terms

We may update these terms as the service evolves. When we do, we will update the date at the top of this page. Continuing to use FanFundU after the updated terms take effect means you accept them.

Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. Subject to any applicable law giving you rights in your place of residence, disputes will be resolved in the state or federal courts located in Florida, and both parties consent to their jurisdiction.

General Terms

A few standard provisions that apply to the whole agreement:

  • Entire agreement. These terms, together with the Privacy Policy and any posted program rules, are the entire agreement between you and FanFundU about the service.
  • Severability. If any provision is found unenforceable, the rest of the terms remain in effect.
  • No waiver. Our not enforcing a provision is not a waiver of our right to enforce it later.
  • Assignment. You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
